While the modern Copyright Act can be traced back to the British Statute of Anne (1709), it wasn\u2019t until 1921 that Canada created its own statute, the statute that we are celebrating this year. <br \/><br \/>La Loi sur le droit d\u2019auteur canadien est int\u00e9ressante parce que, m\u00eame si elle est de comp\u00e9tence f\u00e9d\u00e9rale sous l\u2019article 91(23) de la Loi constitutionnelle de 1867 \u2014 et en principe une loi anglaise \u2014 elle s\u2019inspire \u00e0 la fois des traditions britanniques et continentales. Elle est une loi proprement transsyst\u00e9mique.<br \/><br \/>D\u2019une part, la Loi Loi sur le droit d\u2019auteur s\u2019inspire de la tradition anglaise \u2014 aust\u00e8re et utilitariste \u2014 pour accorder \u00e0 l\u2019auteure des droits \u00e9conomiques, les droits classiques qui r\u00e9compensent son talent et son jugement (CCH c. Barreau du Haut-Canada). D\u2019autre part, la Loi s\u2019inspire du droit continental pour lui accorder des droits moraux. Ces droits sont de nature extrapatrimoniale et permettent \u00e0 l\u2019auteure de contr\u00f4ler comment on emploie son \u0153uvre (Snow v. The Eaton Centre Ltd).<br \/><br \/>The Copyright Act is designed to protect and inspire creativity. And it protects creativity in its most organic form without any kind of formality or registration requirement.
